I think it's less the case for faculty because they have pre-existing
arrangements that cover the status of their work product. Regular staff like
me are just workers for hire, and my work product is owned by the university
lock, stock, and barrel unless other arrangements are made. This is why some
of the "open source" in the world is bogus, you have to own the work to
apply a license to it.

As for how they work as consultants, well, you do the math.

I know mostly from talking to lawyers here and the aforementioned policy
wonk. I'm just repeating their understanding of the rules as they apply to
me, and their claims that this is "the way it is". I'm more than open to the
possibility that they're wrong. The beauty is, nobody knows how to find out.
It's a don't ask, don't tell world, that's why lawyers can always make a
case.
