A potentially important point to note is that the code we would be "re-packaging" is probably NOT currently distributed from within the US. I believe that the two most popular open implementations of the JCE ( http://www.bouncycastle.org/ & http://www.cryptix.org/ ) are currently distributed from outside the US only.

Assuming you're talking about passing along someone else's code, I really
don't think there's anything to worry about, or to do. If we were writing
new crypto and distributing it we might be inclined to send a note to the
BXA to that effect.
