The general wisdom is that the Apple patent does not infringe on the host implementation of IGMPv3/MLDv2 but that it might infringe on the router side, although, during the 10 years that I was working on multicast code at Juniper, there was never any enforcement of it.
By the way, Bruce Simpson has been working on IGMPv3/MLDv2 in the FreeBSD kernel in his spare time so this could eventually work its way into MacOSX. Apple hinted at working on it themselves before the leopard release but when it didn't make it in leopard, its not clear if it was pushed back or dropped.
