This is bizarre, but I literally found this bug last night while I was
building the code with VisualStudio.NET and fixing up some warnings. I filed
it for reference here:

Affects both language versions, since the code base is very similar.
I figured I'd have time to fix it since this is a pretty advanced use case.
The reason for the setParent error is that the child assertions in evidence
are being mis-handled as children of the response.
I don't expect to release a 1.1 patch with just this, but I will fix it in
cvs soon and would appreciate you testing the fix (or you can fix it and
supply me a patch if you need it sooner).
