FWIW, XML Spy appears to be in bad shape all over, so skip that suggestion. I 
ran your sample through XSV and XercesC 2.2 DOMCount
with validation on, and both checked out fine.

The Java samples are such a pain in the butt to use I'm not going to bother, 
but if Xerces J 2.4 has a problem with this, let me or
somebody there know.
